for the provision of accommodation services
Introductory provisions
The company Brno-Living.cz s.r.o., registration number: 08480184, with registered office: Brno, Starobrněnská 286/13, Postal Code 602 00, registered in the Commercial Register maintained by the Regional Court in Brno, file No. C 113875, e-mail: info@goodnite.cz, telephone: +420 530 334 330 (hereinafter also referred to as "Accommodation Provider"), is engaged, inter alia, in the provision of accommodation and related services.
These General Terms and Conditions of Business (hereinafter also referred to as "GTC") regulate the contractual relationship arising between the Accommodation Provider and a natural or legal person (hereinafter also referred to as the "Resident"), the subject of which is the provision of accommodation services to the Resident.
On the basis of the concluded accommodation contract (hereinafter also referred to as the "Contract"), the Accommodation Provider shall provide temporary accommodation (the right to use the defined accommodation space) to the Accommodation Resident for the agreed period of time for the agreed accommodation price and, where applicable, provide related services associated with the accommodation, in accordance with these GTC and the relevant provisions of Act No. 89/2012 Coll., the Civil Code (in particular Sections 2326 et seq.), and, if the Accommodation Resident is a consumer, Act No. 634/1992 Coll., on Consumer Protection. The provisions of these GTC apply unless the parties agree otherwise in writing in the contract.
The GTC become part of any contractual relationship between the Accommodation Provider and the Accommodation Resident, e.g. by reference to the GTC in the Accommodation Resident's order or in its confirmation by the Accommodation Provider. The GTC shall become part of the contractual relationship even if the legal transaction does not contain an explicit reference to the GTC, but the Guest has received the GTC or has otherwise been able to become familiar with them.
The GTC shall also apply mutatis mutandis to the regulation of contractual negotiations prior to the establishment of the contractual relationship, or the relationships resulting therefrom, in the event that the establishment of the contractual relationship does not occur and the potential Guest may have been aware of the GTC.
Establishment and subject matter of the contractual relationship
In case of interest in the realization of any of the services offered by the Accommodation Provider, the Resident shall make an order by filling in and submitting the electronic reservation form on the website https://www.goodnite.cz/, or in writing (e.g. by mail or e-mail), by telephone or in person. The Resident is obliged to provide the Accommodation Provider with true information, in particular:
- name, surname, date of birth, place of residence, contact e-mail address and telephone number of the natural person
- in the case of a legal person or natural person doing business, the business name, registration number, tax identification number, registered office, managing person and contact e-mail address and telephone number
- identification of the person (or persons) to whom the service is to be provided (in particular, name and age, and any other personal data requested), the date of stay and category of accommodation, and the method of payment for the services.
The order, regardless of its designation (e.g. reservation, etc.) becomes binding for the Resident at the moment of its making (e.g. by filling in the order form, sending a written order, telephone or verbal order, etc.) and thus the Resident is obliged to pay the price of the services.
Confirmation of the order by the Accommodation Provider and payment of the price of the services in the required amount shall create a contractual relationship between the Resident and the Accommodation Provider. The Accommodation Provider undertakes to provide the services to the Accommodation Resident in the confirmed scope, time and quality and the Accommodation Resident undertakes to pay the agreed price of services to the Accommodation Provider, or to pay the cancellation fee to the Accommodation Provider in case of cancellation or partial use of the binding reservation, and any other financial benefits, if they are due.
In case the order of the Resident is vague or does not contain all the necessary data or in case of any requests of the Accommodation Provider related to the order, the Resident is obliged to complete his/her order immediately upon the request of the Accommodation Provider. If the Resident fails to complete the order within the specified time and/or fails to meet other conditions as requested by the Accommodation Provider, the Accommodation Provider shall be entitled to cancel the order.
The Accommodation Provider may offer, in particular through the website, the purchase of vouchers for services provided by the Accommodation Provider (accommodation services or other services according to the current offer of the Accommodation Provider). The voucher is valid after payment of its price in full to the Accommodation Provider and can be used under the conditions specified on the voucher or on the Accommodation Provider's website, but no later than 24 (twenty-four) months after its purchase.
